WHAT DOES IT TALK ABOUT?
At June 3, 2021, in bankruptcy proceedings against Purdue Pharma LP, the United States Bankruptcy Court for the Southern District of new York entered a command called “Disclosure declaration order” this:

(a) Purdue Pharma LP and its affiliated debtors and debtors in possession authorized to seek acceptance of Fifth modified Joint Chapter 11 Reorganization Plan of Purdue Pharma LP and its Affiliated Debtors, which includes (a) the release of all actual or potential claims against members of the Sackler family, and certain other related persons and entities, relating to Purdue Pharma LP and its affiliated debtors (including Purdue prescription opioids, such as OxyContin, or other prescription opioids manufactured or sold by Purdue); and (b) an injunction requiring that certain claims against the released parties be brought only against trusts established under the plan;

(b) Approved on Disclosure Statement of the Fifth Amended Chapter 11 Joint Plan for Purdue Pharma LP and its Affiliate Debtors as containing “adequate information“in application of article 1125 of the Bankruptcy Code;

(c) Approved the solicitation materials and documents to be included in the solicitation files; and

(d) Approved procedures for soliciting, receiving and counting votes on the plan and for filing objections to the plan.

The Court will consider the confirmation of the plan at the confirmation hearing.

WHEN IS THE HEARING?
The confirmation hearing will take place on August 9, 2021, at 10:00 a.m., eastern time, before the Honorable Robert D. Drain, in United States South District Bankruptcy Court new York, located at 300, rue Quarropas, White Plains, New York 10601-4140. The hearing will take place via Video conferencing zoom for those who will attend the confirmation hearing1 whether General Order M-543 is still in effect or unless the bankruptcy court orders otherwise.

Confirmation of charges hearing may be extended and rescheduled by court or debtors without further notice by an agenda filed with the Court, and / or by a Notice of Adjournment filed with the Court and delivered to all parties entitled to notice.

Vote on the plan: Your vote must be submitted so that it is actually received no later than July 14th, 2021, at 4:00 p.m., eastern time. Application for allowance: If you believe you have a claim against Purdue Pharma LP which is not currently entitled to vote, but you believe should be entitled to vote, you may request that such claim be allocated for voting purposes. If the plan is confirmed, any person having an actual or potential claim against Purdue Pharma LP or any of its affiliated debtors, or having an actual or potential claim against members of the Sackler family, and certain other related persons and entities, with respect to Purdue Pharma LP and its affiliated debtors (including Purdue prescription opioids, such as OxyContin, or other prescription opioids manufactured or sold by Purdue), will be bound by the terms of the plan, including the releases and injunctions contained therein.
